Workshop Meeting May 23, 2023
The Appomattox Town Council held a Workshop meeting on Tuesday, May 23, 2023 at 6:30 p.m. at the Appomattox Town Hall, Council Chambers, 210 Linden Street, Appomattox, Virginia with Mayor Conner presiding.
Members present: Jane T. Allen, James J. Boyce, Sr., Mary Lou Spiggle, Timothy W. Garrett, Nathan A. Simpson, and Claudia G. Puckette.
Others present: Carlton Duck; Sam Vance; Jeff Elder, Facilities Director; Kim Ray, Town Treasurer; R. Terry McGhee, Town Manager and Roxanne W. Casto, Clerk of Council.
Mayor Conner called the meeting to order and opened the public hearings.
Public Hearing #1: The purpose of the public hearing will be to provide an opportunity to hear public comments for proposed changes to the Water and Sewer Policy User Charges (including Water and Sewer Rates), Connection and Availability Fees Administrative Policy with an effective date of July 1, 2023.

These rate changes are to be enacted pursuant to Section 15.2-2109 et. seq., with specific reference being made to Sections 15.2-2119 and 15.2-2122, of the Code of Virginia, 1950 as amended. Documentation, including the complete ordinance and other information concerning the documentation for the proposed fee are available at the Appomattox Town Office, 210 Linden Street, Appomattox, Virginia from 8:30 a.m. until 4:30 p.m., Monday through Friday. Mayor Conner closed the first public hearing and opened the second public hearing.
Public Hearing #2: The purpose of this public hearing will be to receive public comments concerning the following:
Proposed FY 2024 Budget for the Town of Appomattox - In accordance with §15.2-2506 Code of Virginia, the following is a brief synopsis of the budget proposed by the Town of Appomattox for FY 2024:

The public and all interested parties are invited to attend this public hearing to make their views known on the proposed FY 2024 Budget for the Town of Appomattox. Any person needing special accommodation should contact the Town Office no later than the close of business on the day of the hearing at 434-352-8268.
There were no comments received from the public.
Mayor Conner closed the second public hearing.
CLOSED SESSION: On a motion by Mary Lou Spiggle, seconded by Timmy Garrett, Council voted to convene in Closed Session for consultation with legal counsel to discuss potential acquisition by the Town of certain water infrastructure and assets from Appomattox County, pursuant to Virginia Code Section 2.2-3711(A)(8).
Roll Call Vote: Jane Allen-yes, Jim Boyce-yes, Mary Lou Spiggle-yes, Timmy Garrett-yes, Nathan Simpson-yes, and Claudia Puckette-yes.
The meeting was re-opened to the public.
Jim Boyce made the following motion:
To the best of each member’s knowledge, the only subjects just discussed or considered in the preceding closed meeting were those: (i) lawfully exempted from the FOIA Act’s open-meeting requirements and (ii) properly identified in the motion that convened the closed meeting, pursuant to Virginia Code Section 2.2-3712(D).
The motion was seconded by Timmy Garrett, and Council by the following recorded vote adopted the motion:
Roll Call Vote: Jane Allen-yes, Jim Boyce-yes, Mary Lou Spiggle-yes, Timmy Garrett-yes, Nathan Simpson-yes, and Claudia Puckette-yes.
DISCUSSION:
On a motion by Mr. Garrett, seconded by Mr. Boyce, Council voted to adopt the Utility Water and Sewer Rate structure with an effective date of July 1, 2023. All members present voting aye. Motion carried 6-0.
COUNCIL COMMENTS:
Mayor Conner-Daughter graduated and is looking for jobs.
Mary Lou Spiggle-Wished everyone a happy and safe Memorial Day weekend.

Claudia G. Puckette – She was approached again by Mr. Jamerson regarding the donation to the American Civil War Museum. Is there anyone interested in doing this?
Mr. Simpson made a motion to give a one-time donation of $5,000 to the American Civil War Museum. Motion died for lack of a second.
Mr. Simpson asked Mrs. Puckette what was her point? Mrs. Puckette stated she promised Mr. Jamerson she would bring it up.
Nathan A. Simpson – Asked about the status of the slate roof at the Train Depot to which Mr. McGhee replied that it is halfway complete.
James J. Boyce – Be attentive to a veteran. All gave some, some gave all. His son was in Iraq and nephew in Kuwait. Thoughts are with the kids whose dad never made it back.

STANDING COMMITTEE REPORTS:
Finance and Planning/ARPA-$60,000 for GPS/GIS can be paid from ARPA funds.
On a motion by Mr. Garrett, seconded by Mr. Boyce, Council voted to reallocate funding for GPS/GIS from the FY2024 proposed budget to ARPA and Council by the following recorded vote adopted the motion:

STAFF REPORTS:
Mr. Elder-none
Kim Ray-Provided the April 2023 financial report, which is 10 months into the fiscal year.
Mr. McGhee also reported on the following items:
- Jeff Elder dropped off the contract for the land to Tiger Fuel.
- Train depot update-the back deck is complete, entry deck is halfway complete, roofers
separated the roof into six sections, and they have completed the removal of old material from one section.
- To paint the building back to the historic colors would be between $19,000-23,000. We
will probably need to vote on this at the next meeting.

- We received three generator bids. The low bidder didn’t include a required item. They
have been sent a notification that they may be a non-responsive bidder and given 10 days for rebuttal.
The Church St waterline project is still in limbo with the US Department of Agriculture. We are waiting for the acceptance of BABA (Build America, Buy America) program. It is likely they will provide us with an additional $500,000 in grant money. Another loan is also a possibility.
A letter has been drafted for Urgent Care. Dr. Jeff Garrett has approved the letter and sent it to three regional urgent care facilities and the top ten national urgent care facilities.
Kim has called other localities asking how they handle external agency donations.
Sample guidelines have been provided in the manager’s report. 8. All projects are being tracked including all ARPA money spent.
Claudia G. Puckette-asked if there were any updates on the renovation of the Town Hall building. Mr. McGhee stated that Dominion 7 was here earlier today taking measurements. They will return to measure downstairs.

On a motion by Mr. Garrett, seconded by Mr. Simpson, Council voted to adjourn at 8:12 pm. All council members present voting aye. Motion carried 6-0.
