The Appomattox Town Council held a Regular Council meeting on Monday, June 13, 2016 at 7:30 p.m. at the Appomattox Municipal Building, 210 Linden Street, Appomattox, Virginia with Mayor Harvey presiding.
Members present: Timothy W. Garrett, C. Lewis McDearmon, Jr., Mary Lou Spiggle, M. Erin Finch, Steven T. Conner, and Claudia G. Puckette

Mayor Harvey called the Regular Council meeting to order and welcomed the visitors.
Rev. Carlton Duck led the prayer and Pledge of Allegiance.
Mrs. Janet A. Hix, Appomattox County Clerk of the Circuit Court appeared to administer the Oath of Office to the Mayor and Council Members for the next ensuring term of office – July 1, 2016 – June 30, 2018.
Citizen Comment Period: Don & Nancy Wilk – 1900 Church Street, Appomattox, Virginia Mr. and Mrs. Wilk appeared before Council to express their intent to purchase the former Appomattox Team Room on Church Street and their desire to have a specialty artisan market in the lower level and are requesting to live upstairs. The market will include real food from local growers and hopefully organic will become the new normal. They have a concept of farm to table restaurant and upstairs residency. There are 10 parking spaces available in the rear of the property. They expect to close on the property at the end of the month.
Shirley Walker – P O Box 2106, Appomattox, Virginia and works at Hometown Pharmacy appeared before Council because of a disturbing incident in the parking lot at the Triangle Plaza. Five (5) men had her car surrounded and would not let her leave. She called the Sheriff’s Office and the deputy talked to her like she had done something wrong. She didn’t appreciate what happened. She said Sheriff Letterman treated her like a joke. She said she wasn’t sure what the protocol was for this but something needs to be done. There is broken glass and kids trashing the parking lot at the Triangle Plaza. She said the owner of the property has called the Sheriff and the Sheriff isn’t very receptive. Nothing seems to be getting done. She wanted to know how the Council could help to solve this problem before it gets any worse.
Mayor’s Comments: Mayor Harvey invited the community to a “Town Community Visioning” meeting on Tuesday, June 1st from 5:30 – 7:30 p.m. at the Appomattox Visitor’s Information Center, 210 Main Street, Appomattox, Virginia. This meeting will give property owners, etc. an opportunity to share ideas of the business district area, a timeline of activities, etc. It is vital to get input from those groups of people. As the project organizers, we need your input.

Mayor Harvey welcomed Mr. Gabathuler, who began June 1st as the new Town Manager. Mayor also thanked Mr. Gillespie (who was in the audience) for hanging around during the transition phase.

Consent Agenda - On a motion by Mr. Garrett, seconded by Ms. Spiggle, Council voted to adopt the consent agenda for Monday, May 9, 2016 with the addition of New Business #4 – consideration to adopt a Resolution amending the FY 2016 Operating Budget for the General Fund. Vote: Garrett –yes, McDearmon – yes, Spiggle – yes, Finch – yes, Conner – yes, Puckette – yes. Motion carried 6-0.

New Business – On a motion by Mr. Conner, seconded by Ms. Spiggle, Council voted to accept the fee proposals from Reid Engineering for $315,879.10 and CHA Engineering for $192,504 for the Inflow and Infiltration Study. Roll call vote: Garrett –yes, McDearmon – yes, Spiggle – yes, Finch – yes, Conner – yes, Puckette – yes. Motion carried 6-0.

AN APPROPRIATIONS RESOLUTION OF THE APPOMATTOX TOWN COUNCIL ADOPTING THE FISCAL YEAR 2016-2017 BUDGET FOR THE TOWN OF APPOMATTOX, VA.
SECTION I: WHEREAS, Section 5-72, Appomattox Town Code and Section 15.2-2503, Code of Virginia, require that the governing body shall approve the budget and fix a tax rate for the budget year no later than the date on which fiscal year begins; and,
SECTION II: WHEREAS, the proposed Fiscal Year 2016-2017 Budget was published on May 11 and 18, 2016 in the Times-Virginian, Appomattox, Virginia, pursuant to Section 15.2-2506, Code of Virginia, and public hearing was subsequently held on the proposed budget on Wednesday, May 25, 2016;
SECTION III: NOW, THEREFORE, BE IT RESOLVED, that the Appomattox Town Council meeting in General Session on June 13, 2016, does hereby approve the following General Fund Expenditures by Category for Fiscal Year 2016-2017;

SECTION IV: BE IT FURTHER RESOLVED, that the Appomattox Town Council hereby establishes the property tax rate at $.12 per $100.00 of assessed value for real estate, $.55 per $100.00 of assessed value for personal property, $.55 per $100.00 of assessed value for machinery and tools, and $.12 per $100.00 of assessed value for mobile homes; and,
BE IT FURTHER RESOLVED, in accordance with the requirements set forth in Section 58.1- 3524(C)(2) and Section 58.1-3912(E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1) and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of Assembly any qualifying vehicle sitused within the Town commencing January 1, 2016, shall receive personal property tax relief in the following manner:
• Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief; • Personal use vehicles valued at $1,001 to $20,000 will be eligible for 54.8% tax relief; • Personal use vehicles valued at $20,001 or more shall only receive 54.8% tax relief on
the first $20,000 of value; and
• All other vehicles which do not meet the definition of “qualifying” (business use vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program.

Treasurer’s Report – Ms. Stacey Wilkes, Town Treasurer presented the Town’s financial report for April 2016. She is still expecting a $400,000 surplus for the general fund. The water fund is breaking even and the sewer fund is ahead by about $30,000 after the emergency purchase of a generator.
Mr. Garrett asked if the Cigarette Tax is doing as well as expected? Ms. Wilkes advised that being able to meet the anticipated budget amount may be close for this fiscal year.
Town Manager’s Update – No report
Council Concerns: Mr. Garrett suggested the Town have Sheriff Letterman address Ms. Walker’s concerns. He also suggested that Ms. Walker contact the County Board of Supervisors also with her concerns.
Also, there are skateboarders in Town again. They are dodging cars and on school property. Mr. Garrett suggested speaking with the Town Attorney and Sheriff Letterman.
