The Appomattox Town Council held a Regular Council meeting on Monday, June 8, 2015 at 7:30 p.m. at the Appomattox Municipal Building, 210 Linden Street, Appomattox, Virginia with Mayor Harvey presiding.

Members present: Timothy W. Garrett, C. Lewis McDearmon, Jr., Mary Lou Spiggle, Steven T. Conner, Claudia G. Puckette and vacancy.

Others present: Daniel Puckette, Times Virginian; Carlton Duck and Brian Moore, Alive Media TV; Nathan Harbin and Proctor Harvey, HDLA; Carolyn Mayberry and Greg Mayberry, Rev. Russell Cheatham, C. William Gillespie, Jr., Town Manager, Stacey Wilkes, Town Treasurer; and Roxanne Casto, Town Clerk.

Mayor Harvey called the meeting to order.

Rev. Russell Cheatham, Memorial United Methodist Church opened the meeting with a prayer and led the Pledge of Allegiance.

Mayor’s Comments:

Mayor Harvey presented a Proclamation of Service to Carolyn and Greg Mayberry for Mr. Norman H. “Jimmy” Mayberry’s service as Council Member for 19 years. Mr. Mayberry passed away on May 14, 2015 at the age of 72.

PROCLAMATION

Whereas, Norman H. “Jimmy” Mayberry served as a member of the Appomattox Town Council since 1995; and

Whereas, Mr. Mayberry untiringly devoted over 19 years to our community during a period of time that numerous projects were initiated through his leadership which will continue to have a revitalizing and growing impact on our community far beyond his term of office; and

Whereas, Mr. Mayberry was always willing to place his concern for the public good ahead of his personal interests and thus, has earned the admiration and high regard of other civic leaders and the affection of a host of area residents; and

Whereas, Mr. Mayberry was unique in his sensitivity for doing what was best for the entire community, and he had courage in expressing his convictions and a special way of dealing with complex issues; and

Whereas, if there was one characteristic that distinguished Mr. Mayberry’s career as a public servant, it was his enormous capacity for hard work – no one in these parts ever put more of himself into the job of working for his community than did Mr. Mayberry; and

Whereas, Mr. Mayberry demonstrated in many practical ways his deep and genuine love for our community and the surrounding area;

Now, Therefore, I, Mayor Paul D. Harvey, wish to express our sincere appreciation and thanks to the family of Mr. Mayberry for his distinguished service to the community, and highly commend him for the manner in which he carried out his duties and responsibilities.

Scheduled Public Appearances – Harvey Design Land Architects – Nathan Harbin and Proctor Harvey presented the CDBG/DHCD Grant Central Business District Map to Council. The Town has been awarded a $5000 planning grant and a $20,000 atheistic grant. The application was made in mid-March. Council offered several suggestions to the proposed map by adding additional property.

The deadline to comply with the requirements of the $5000 planning grant is July 8, 2015.

There will be a management team meeting for businesses to understand the process before the July 8, 2015 deadline.

Consent Agenda – On a motion by Mr. Conner, seconded by Mr. Garrett, Council voted to approve the consent agenda dated June 8, 2015 with the addition of NB#4 – Consideration to authorize the Mayor to execute the following document associated with the Greater Meadowlark CDBG project: Town of Appomattox – Section 3 – Local Business and Employment Plan; Town of Appomattox – Residential Anti-Displacement Plan; Town of Appomattox Non-Discrimination Plan; Town of Appomattox – Fair Housing Certification; Town of Appomattox – Section 504 Grievance Procedure and NB#5 – Consideration to appoint Mary Lou Spiggle to fill the unexpired term of Mr. Mayberry on the Town’s Economic Development Authority. Vote: Garrett – yes, McDearmon – yes, Spiggle – yes, Conner – yes, Puckette – yes. Motion carried 5-0.

New Business – On a motion by Mr. Garrett, seconded by Mr. McDearmon, Council voted to adopt an Appropriations Resolution of the Appomattox Town Council adopting the Fiscal Year 2015- 2016 Budget for the Town of Appomattox, Virginia.

AN APPROPRIATIONS RESOLUTION OF THE APPOMATTOX TOWN COUNCIL ADOPTING THE FISCAL YEAR 2015-2016 BUDGET FOR THE TOWN OF APPOMATTOX, VA.

SECTION I: WHEREAS, Section 5-72, Appomattox Town Code and Section 15.2-2503, Code of Virginia, require that the governing body shall approve the budget and fix a tax rate for the budget year no later than the date on which fiscal year begins; and,

SECTION II: WHEREAS, the proposed Fiscal Year 2015-2016 Budget was published on April 29, 2015 and May 6, 2015 in the Times-Virginian, Appomattox, Virginia, pursuant to Section 15.2-2506, Code of Virginia, and public hearing was subsequently held on the proposed budget on Monday, May 11, 2015;

SECTION III: NOW, THEREFORE, BE IT RESOLVED, that the Appomattox Town Council meeting in General Session on June 8, 2015, does hereby approve the following General Fund Expenditures by Category for Fiscal Year 2015-2016;

SECTION IV: BE IT FURTHER RESOLVED, that the Appomattox Town Council hereby establishes the property tax rate at $.12 per $100.00 of assessed value for real estate, $.55 per $100.00 of assessed value for personal property, $.55 per $100.00 of assessed value for machinery and tools, and $.12 per $100.00 of assessed value for mobile homes; and,

BE IT FURTHER RESOLVED, in accordance with the requirements set forth in Section 58.1- 3524(C)(2) and Section 58.1-3912(E) of the Code of Virginia, as amended by Chapter 1 of the Acts of Assembly (2004 Special Session 1) and as set forth in Item 503.E (Personal Property Tax Relief Program) of Chapter 951 of the 2005 Acts of Assembly any qualifying vehicle sitused within the Town commencing January 1, 2015, shall receive personal property tax relief in the following manner:

• Personal use vehicles valued at $1,000 or less will be eligible for 100% tax relief; • Personal use vehicles valued at $1,001 to $20,000 will be eligible for 54.8% tax relief; • Personal use vehicles valued at $20,001 or more shall only receive 54.8% tax relief on

the first $20,000 of value; and

• All other vehicles which do not meet the definition of “qualifying” (business use

vehicles, farm use vehicles, motor homes, etc.) will not be eligible for any form of tax relief under this program.

SECTION V: BE IT FURTHER RESOLVED, that the Appomattox Town Council does hereby approve the following General Fund revenue estimates for Fiscal Year 2015-2016;

SECTION X: BE IT FURTHER RESOLVED, that the Appomattox Town Council may amend the Fiscal Year 2015-2016 Town Budget from time to time pursuant to Section 15.2-2507, Code of Virginia; and,

SECTION XI: BE IT FURTHER RESOLVED, by the Town Council of Appomattox, Virginia that the Fiscal Year Budget for 2015-2016 is hereby adopted, effective July 1, 2015 and the monies necessary to fund it are hereby appropriated and shall be certified by the Clerk of Council and maintained as an archive document with the official minutes of the Town Council of Appomattox, Virginia.

Vote: Garrett – yes, McDearmon – yes, Spiggle – yes, Conner – yes, Puckette – yes. Motion carried 5-0.

On a motion by Mr. Garrett, seconded by Ms. Spiggle, Council voted to award the Engineering Basic Ordering Agreements to Anderson & Associates, Inc., B & B Consultants, Hurt & Proffitt, Inc., WW Associates and Reid Engineering. Vote: Garrett – yes, McDearmon – yes, Spiggle –yes, Conner – yes, Puckette – yes. Motion carried 5-0.

On a motion by Mr. McDearmon, seconded by Ms. Spiggle, Council voted to adopt a Resolution amending the FY 2015 Operating Budget for the General Fund 2014-2015 for revenue to be received from the Community Development Block Grant and appropriate those funds for expenses incurred toward the project, additional funding for the ROSE program, and additional funding for current year CIP projects and amending the FY 2015 Operating Budget for the Water Fund for FY 2014-2015 for the current year CIP projects.

Consideration to adopt a resolution amending the FY 2015 Operating Budget for the General Fund for FY 2014-2015 for revenue to be received from the Community Development Block Grant and appropriate those funds for expenses incurred toward the project, additional funding for the ROSE program, additional funding for administrative staff expenses, and funding for current year CIP projects and amending the FY 2015 Operating Budget for the Water Fund for FY 2014-2015 for current year CIP projects.

WHEREAS, Section15.2-2507, Code of Virginia, allows that a governing body may amend the budget from time to time

NOW THEREFORE, BE IT RESOLVED, that the Appomattox Town Council does hereby amend the FY 2015 Operating Budget for the General Fund for FY 2014-2015 for revenue to be received from the Community Development Block Grant and appropriate those funds for expenses incurred toward the project, additional funding for the ROSE program, and additional funding for administrative staff expenses

SECTION XIII: BE IT FURTHER RESOLVED, by the Town Council of Appomattox, Virginia that the Fiscal Year 2015 budget amendments are hereby adopted, and the monies necessary to fund it are hereby appropriated and shall be certified by the Clerk of Council and maintained as an archive document with the official minutes of the Town Council of Appomattox, Virginia. Amended this 8th day of June 2015.

Vote: Garrett – yes, McDearmon – yes, Spiggle – yes, Conner – yes, Puckette – yes. Motion carried 5-0.

Vote: Garrett – yes, McDearmon – yes, Spiggle – yes, Conner – yes, Puckette – yes. Motion carried 5-0.

Town Manager’s Report – Mr. Gillespie provided Council with an update regarding Lindenburg Industries. Blair Construction and Southern Air have been working on the building.

The hotel project (Appomattox Inn and Suites) will be finishing work on the extension of water and sewer lines and installation of the sewer pump station tomorrow, June 9, 2015. The project is within budget.

On a motion by Mr. McDearmon, seconded by Mr. Conner, Council voted to recess to Monday, June 15, 2015 at 6:00 p.m. pending information on how to fill the Council vacant seat. Vote: Garrett – yes, McDearmon – yes, Spiggle – yes, Conner – yes, Puckette – yes. Motion carried 5-0.
