1 Regular Council Meeting Monday, January 14, 2013
The Appomattox Town Council held a Regular Council Meeting on Monday, January 14, 2013 at 7:30 p.m. at the Appomattox Municipal Building, 210 Linden Street, Appomattox, Virginia, with Mayor Harvey, presiding.
Members present: Timothy W. “Timmy” Garrett, C. Lewis McDearmon, Jr., Mary Lou Spiggle, N.H. “Jimmy” Mayberry, Steven T. “Steve” Conner and Claudia G. Puckette.
Others Present: Stephanie James, Chad Millner, Sam Carter, Carlton Duck and Alive TV Crew, Stacey Wilkes, Town Treasurer; C. William Gillespie, Interim Town Manager and Roxanne W. Paulette, Clerk of Council.
Mayor Harvey called the meeting to order and welcomed everyone.
Rev. Carlton Duck led the invocation.
Rev. Carlton Duck also led the Pledge of Allegiance.
Mayor’s Comments: Mayor Harvey wished everyone a Happy New Year. He also thanked Council and Town Staff for the peace lily sent to the house for the passing of his father, Clifford Harvey. All of the visits, phone calls, thoughts and prayers were much appreciated by him and his family.
Consent Agenda On a motion by Councilmember Mayberry, seconded by Councilmember Garrett, Council voted to adopt the consent agenda of January 14, 2013. All members present voting aye. Motion carried.
Unfinished Business None
New Business On a motion by Councilmember Mayberry, seconded by Councilmember McDearmon, Council voted to amend the Travel Policy by increasing the mileage reimbursement rate from $0.555 to $0.565 retroactive to January 1, 2013. All members present voting aye. Motion carried.
On a motion by Councilmember Conner, seconded by Councilmember Garrett, Council voted to adopt the 2013 Appomattox Town Council Meeting Schedule. All members present voting aye. Motion carried.

On a motion by Councilmember McDearmon, seconded by Councilmember Mayberry, Council voted to adopt the following resolution:
Resolution requesting repairs to Rail Crossing No. 467991R at Court Street – Town of Appomattox
WHEREAS, the vehicular crossing of the Norfolk/Southern Railway tracks located on Court Street (Crossing No. 467991R) in the Town of Appomattox has served the Town of Appomattox community for many years as the Town’s primary access for one of its two primary traffic corridors, and
WHEREAS, this crossing has become extremely rough with pavement breaking up and the mechanically fastened crossing material becoming loose is proving to be a traffic hazard in addition to causing vehicular damage particularly passenger cars, and
WHEREAS, the Town of Appomattox depends on the Court Street corridor and particularly this crossing as a major thoroughfare for a large portion of its commercial and residential vehicular traffic; and
WHEREAS, the Town of Appomattox has received numerous complaints regarding the condition of this crossing coupled with requests that the crossing be repaired, and
WHEREAS, the Town Council has been petitioned by the business and residential community to request that Norfolk/Southern address the deteriorating condition of this crossing.
NOW, THEREFORE, BE IT RESOLVED, that the Town of Appomattox, Virginia does hereby respectively request that Norfolk/Southern address the maintenance needs of the Court Street rail crossing No. 467991R in the Town of Appomattox.
All members present voting aye. Motion carried.
On a motion by Councilmember Puckette, seconded by Councilmember Garrett, Council voted to write off uncollected debts that have exceeded the statue of limitations, specifically $3297.94 (Personal Property taxes) and $24.15 (Real Estate taxes). All members present voting aye. Motion carried.
On a motion by Councilmember Conner, seconded by Councilmember Spiggle, Council voted to adopt the 2013 Priorities and Initiatives (attached) as presented. All members present voting aye. Motion carried.
