1 Regular Council Meeting Monday, May 14, 2012

The Appomattox Town Council held a Regular Council Meeting on Monday, May 14, 2012 at 7:30 p.m. at the Appomattox Municipal Building, 210 Linden Street, Appomattox, Virginia, with Mayor Harvey presiding.

Members present: Timothy W. “Timmy” Garrett, C. Lewis McDearmon, Mary Lou Spiggle, N.H. “Jimmy” Mayberry, Steven T. “Steve” Conner and Joyce B. Bennett.

Others Present: Lucy Harvey, Benny Harvey, Claudia Puckette, Jeff Elder, Utility Director, Jim Gallegher (Our Lady of Peace Catholic church), Stephanie James, Carlton Duck and Alive TV Crew, Stacey Wilkes, Town Treasurer; C. William Gillespie, Interim Town Manager and Roxanne W. Paulette, Clerk of Council.

Mayor Harvey called the meeting to order and welcomed everyone.

Father Gallegher, Our Lady of Peace Catholic Church led the invocation.

Father Gallegher also led the Pledge of Allegiance.

Mayor Harvey opened the public hearing.

The purpose of this public hearing will be to receive public comments concerning the following:

  1. Proposed changes to the Water and Sewer Policy User Charges (including Water and Sewer Rates), Connection and Availability Fees Administrative Policy with an effective date of July 1, 2012.

a) Proposed Water Rates:

Charge for the first 2000 gallons of metered consumption - $10.00 Charge per 1000 gallons over 2000 - $5.80

b) Proposed Sewer Rates:

July 1, 2014

July 1, 2015

These rate changes are to be enacted pursuant to Section 15.2-2109 et. seq., with specific reference being made to Sections 15.2-2119 and 15.2-2122, of the Code of Virginia, 1950 as amended.

  1. Proposed FY 2013 Budget for the Town of Appomattox - In accordance with §15.2-2506 Code of Virginia, the following is a brief synopsis of the budget proposed by the Town of Appomattox for FY 2013:

There were no public comments during the public hearing.

On a motion by Councilmember Bennett, seconded by Councilmember Garrett, Council voted to close the public hearing. All members present voting aye. Motion carried.

Scheduled Public Appearances – None

Mayor’s Comments Mayor Harvey thanked Mr. Gillespie and Mr. Elder for all their efforts in prepping the area at the Public Works Building Site. Their efforts along with the Public Works Department have saved the Town a tremendous amount of money.

Consent Agenda On a motion by Councilmember Mayberry, seconded by Councilmember McDearmon, Council voted to approve the consent agenda as presented for May 14, 2012. All members present voting aye. Motion carried.

Unfinished Business None

New Business

On a motion by Councilmember McDearmon, seconded by Councilmember Bennett, Council voted to adopt the following resolution:

WHEREAS, Section15.2-2507, Code of Virginia, allows that a governing body may amend the budget from time to time

NOW THEREFORE, BE IT RESOLVED, that the Appomattox Town Council does hereby amend the FY 2011-2012 Operating Budget of the Water Fund and Sewer Fund to carryover unspent STAG grant funds and bond proceeds from FY 2011 to appropriate those funds to be spent during FY 2012 for completion of the STAG project and the retirement of debt as follows:

SECTION XIII: BE IT FURTHER RESOLVED, by the Town Council of Appomattox, Virginia that the Fiscal Year 2012 budget amendments are hereby adopted, and the monies necessary to fund it are hereby appropriated and shall be certified by the Clerk of Council and maintained as an archive document with the official minutes of the Town Council of Appomattox, Virginia.

Amended this 14th day of May 2012. All members present voting aye. Motion carried.

On a motion by Councilmember Garrett, seconded by Councilmember Spiggle, Council voted to amend the Accounts Receivable Water & Sewer policy #7 - $25 disconnect fee will charged for any customer cut-off for non-payment and a $25 reconnect fee will be charged to restore service. All members present voting aye. Motion carried.

On a motion by Councilmember Mayberry, seconded by Councilmember McDearmon, Council voted to appoint Allen Austin to the Appomattox Town Tree Board with a term expiring December 31, 2013. All members present voting aye. Motion carried.

On a motion by Councilmember McDearmon, seconded by Councilmember Garrett, Council voted to adjourn the meeting at 7:50 p.m. All members present voting aye. Motion carried.
