SPECIAL CALL — January 21, 2004 A Special Call meeting of the Appomattox Town Council was held on Wednesday, January 21, 2004 at 5:30 p.m. at the Town Office with Mayor Spiggle, presiding.

Members present: .W. H. Carson, N. H. Mayberry, M. H. Mitchell, C. L. McDearmon, Joyce Bennett and S. E. Lawson.

Others present: David Tt Garrett, Jr., Town Manager and Roxanne W. Paulette, Clerk.

David Garrett explained to Town Council the “No fault” vs, “Sovreign Immunity” as explained to him by VML Insurance Programs. .

On a motion by Mr. Mitchell, seconded by Mr. McDearmon, council voted to rescind the previous motion of January 12, 2004 that waived Sovreign Immunity and gave Mr. Lawson fair value as determined by the insurance company after further investigation.

Vote - Carson — aye, Mayberry — aye, Mitchell -- aye, McDearmon — aye, Bennett— aye. Lawson — abstained.

Motion carried.

On a motion by Mr. McDeatmon, seconded by Ms. Bennett, Council voted to adjourn at 5:52 p.m. All voting aye. Motion carried. C.
